22 years for raping ECD pupil

A BUDIRIRO 5B man will spend 22 years behind bars for raping an ECD B pupil after they had been sharing the same bedroom for the past one year.
Trust Polani, 25, was convicted on his own plea when he appeared before Harare Regional magistrate Temba Kuwanda charged with two counts of rape.
Initially, he was sentenced to a combined 27 years behind bars for the two counts of which five years were set aside on condition of good behavior and that he does not commit a similar offence for the next five years.
During mitigation, he told the court that he did not know what got into him and blamed the crime on evil spirits.
He begged for forgiveness from the child’s parents and told the court that he will not do it again.
However, the State asked the court to give him a deterrent sentence since he had taken advantage of the child.
The State argued that Polani exposed the juvenile to early sexual experience hence posing danger to her own life.
“Your Worship this man breached the trust that the parents of the child had over him.
“He also exposed the child to diseases especially the deadly virus hence he should not go unpunished.
“The child looked at him as a father figure since she saw him as an uncle by he betrayed that trust,” he said.
Circumstances leading to the conviction are that on a date unknown to the State when the child was still doing ECD B, she came home from school and found Polani alone. He then called her into the dining room to watch television.
Polani went to where the child was before he told her to lie down on the sofa and remove her clothes.
The court heard that he went on to rape the child once and threatened her not to tell anyone.
He is said to have continued to do this until he was caught red handed by the juvenile’s mother.
The court heard that the mother of the child just walked in on him before he jumped away from the child.
The mother called her husband who then made a police report leading to Polani’s arrest.
