Cousins fight over estate

A HARARE man is at odds with his cousin who claims that his house belonged to his late father.
Simbarashe Mararutse opened up at the Harare Civil Court where he was applying for a protection order against Kudakwashe Mararutse.
“Your Worship I am applying for a protection order against my brother who is violent and claims that my house belonged to his late father.
“He comes to my place of residence harassing me threatening to occupy my house by force.
“The house belongs to me, but he doesn’t know that because our late fathers used to rent together at this house.
“Our fathers were brothers and they used to rent at this house which belonged to a Zambian man who is now late. When this man died our fathers remained in this house.
“I continued staying in this house till the City Council advised me that it was not our house and I bought the house. Now he comes breaking doors and windows,” he said.
In response Kudakwashe remained adamant that the house belonged to his late father.
“Your Worship the house belonged to my late father and I saw the house address on my birth certificate.
“My father passed away in 2003 so I do not know why the house is registered in my brother’s name. I now want to occupy the house with my family,” he said
“I am not violent but I simply knocked the door and his tenant told me that he had been advised to lock me out.
Presiding magistrate Nyasha Marufu dismissed the application and advised the Simbarashe to seek an interdict saying there is no evidence showing why he wants a protection order.
