Teen jailed 12 years for murder

A ZVISHAVANE teenager was yesterday sentenced to 12 effective years in jail for stabbing his workmates’ friend after they had a misunderstanding over a razorblade.
Decent Maphosa (18) of Zvishavane mining town was convicted of murder which was found not to be premeditated but self-defense by High Court Judge Justice Nicolas Mathonsi.
Maphosa stabbed Menshevicks Moyo, the now deceased, in August last year.
In passing sentence, Justice Mathonsi said Maphosa’s behaviour was because of immaturity and lack of guidance since he came from a broken family with no one to nurture him. He said the murder was not pre-planned but it was in self defence since the deceased was drunk and aggressive towards the accused.
“The accused is young and still has a future ahead. However, because of immaturity and lack of guidance he has found himself on the wrong side of the law. The murder as assessed was not pre-planned but it was out of defending himself from the deceased.
“However there was loss of precious life in defending himself therefore justice should be practiced hence you are sentenced to 12 years in prison,” said Justice Mathonsi.
During the trial Maphosa testified that he was scared of the way the deceased was reacting hence he used the okapi knife so as to scare him away since he was older and stronger than him but unfortunately he continued charging towards where he was leading to him unknowingly stabbing him.
“I was scared because Moyo was older and bigger than me. I had to scare him away using the knife however he continued charging towards me even when I was waving the knife sideways leading to him being hurt after I stabbed him unintentionally,” said Maphosa.
It is the state case that, on August 27 last year Moyo the now deceased was on his way to watch soccer when he passed by Edgars Stores to collect his friend Hillary Ndlovu who is a vendor outside Edgars in Zvishavane.
The accused wanted to put a screen guard on one of his customers’ phone and he just rushed to pick a razor blade that was on his neighbouring vendor‘s table.
Moyo then advised him not to take people’s wares without paying. He then rushed towards Maphosa and lifted him up , throwing him on the floor.
The accused then took a knife from his pocket and stabbed the deceased once on the ribs causing a deep cut. After they had separated Moyo then became powerless as he bled heavily and fell down.
Upon seeing the incident Ndlovu hired a taxi to take Moyo to the police to make a report so that they could take him to the hospital. However before they arrived at the police station Moyo passed out and died. The body was later taken to Bulawayo Hospital mortuary for post mortem.
The matter was reported to the police leading to Maphosa’s arrest last year.
