Woman sues tenant over legal costs
26 January 2018
A HARARE woman yesterday applied for compensation for the legal costs she incurred while suing her tenant for overdue arrears.
Yvonne Ewinga appeared before Harare Civil Court with an application for compensation from her former tenant Vimbai Tizauone.
Ewinga said in October last year, Tizauone had arrears in her rentals and advised her to take some of her properties as compensation for the arrears.
“After giving me the property, she went on to report me to the police, that I had taken her property without her consent.
“She took me to court for that, so today I am suing her for the costs I incurred by hiring lawyers to represent me in court. I lost the case and she got back her property so I want $300.”
In response Tizauone opposed the claim and justified herself.
“I dispute what she is saying because I don’t know the costs she incurred with the lawyers and she took my property without my consent so she deserved to lose the case,” said Tizauone.
The case was dismissed by Magistrate Nyasha Marufu who presided over the matter because there was no clear basis over the claim.
